Identity of the seller<\/h2>\n<div>\n<p>These General Terms and Conditions of Sale (hereinafter &#8220;Terms&#8221;) govern the sale of products made through the website www.capocciabio.it (hereinafter &#8220;Site&#8221;).<\/p>\n<p>Seller:<br \/>Capoccia Bio Azienda Agricola s.s.<br \/>Owner: Gabriele Capoccia<br \/>Headquarters: Italy<br \/>P. Scope of application.<\/h2>\n<div>\n<p data-start=\"1075\" data-end=\"1245\">These Terms apply to <strong data-start=\"1113\" data-end=\"1145\">all sales of products<\/strong> made through the Site to <strong data-start=\"1185\" data-end=\"1200\">consumers<\/strong> within the meaning of Article 3 of the Consumer Code. <\/p>\n<p data-start=\"1247\" data-end=\"1418\">&#8220;Consumer&#8221; means a natural person who purchases for purposes unrelated to any entrepreneurial, commercial, craft or professional activity.<\/p>\n<\/div>\n<h2>3. Subject of the contract<\/h2>\n<div>\n<p>The contract is for the sale of organic food products and agricultural derivatives (by way of example: flours, pasta, legumes, baked goods), as described in the product sheets on the Site.<\/p>\n<p>Images and descriptions are for illustrative purposes; any slight differences do not constitute a lack of conformity.<\/p>\n<\/div>\n<h2>4. Conclusion of the contract<\/h2>\n<div>\n<p>The contract is considered concluded when:<\/p>\n<ul>\n<li>the Customer selects products and places them in the shopping cart;<\/li>\n<li>Confirm the order by completing the checkout process;<\/li>\n<li>receives an order confirmation e-mail from the Seller.<\/li>\n<\/ul>\n<p>The Seller reserves the right not to accept the order in case of unavailability of products or incorrect data, giving notice to the Customer.<\/p>\n<\/div>\n<h2>5. Prices<\/h2>\n<div>\n<p data-start=\"2256\" data-end=\"2341\">All prices are in <strong data-start=\"2288\" data-end=\"2296\">Euros<\/strong>, <strong data-start=\"2298\" data-end=\"2313\">VAT included<\/strong>, unless otherwise stated.<\/p>\n<p data-start=\"2343\" data-end=\"2427\">Shipping charges are shown separately before order confirmation.<\/p>\n<p data-start=\"2429\" data-end=\"2595\">The Seller reserves the right to change prices at any time, with the understanding that the Customer will be charged the price in effect at the time of the order.<\/p>\n<\/div>\n<h2>6. Methods of payment<\/h2>\n<div>\n<p>The following payment methods are accepted:<\/p>\n<ul>\n<li>credit\/debit cards<\/li>\n<li>electronic payment systems (e.g., PayPal)<\/li>\n<li>other methods indicated in the checkout pages<\/li>\n<\/ul>\n<p>Payment is due at the time the order is placed.<br \/>Payment information is not managed or stored by the Seller.<\/p>\n<\/div>\n<h2>7. Shipping and delivery<\/h2>\n<div>\n<p>Delivery is made to the address given by the Customer when ordering.<\/p>\n<p>Delivery times are approximate and non-essential; any delays not attributable to the Seller will not entitle to compensation.<\/p>\n<p>Upon delivery, the Customer is required to check the integrity of the package and report any anomalies.<\/p>\n<\/div>\n<h2>8. Availability of products<\/h2>\n<div>\n<p>In case of unexpected unavailability of one or more products, the Customer will be informed and may choose between:<\/p>\n<ul>\n<li>Refund of the amount paid;<\/li>\n<li>Replacement with equivalent product (with prior consent).<\/li>\n<\/ul>\n<\/div>\n<h2>9. Right of withdrawal<\/h2>\n<div>\n<p>Pursuant to Article 59(d) and (e) of the Consumer Code, the right of withdrawal is excluded for:   <\/p>\n<ul>\n<li>Perishable food products or those subject to rapid deterioration;<\/li>\n<li>Sealed products that are not suitable to be returned for hygienic reasons and have been opened.<\/li>\n<\/ul>\n<p>For products for which withdrawal is permitted, the Customer may exercise it within 14 days of delivery by notifying the Seller in writing.<\/p>\n<p>Return costs are the responsibility of the Customer.<\/p>\n<\/div>\n<h2>10. Legal guarantee of conformity<\/h2>\n<div>\n<p>The products are covered by the legal warranty of conformity provided for in Articles 128-135 of the Consumer Code.<\/p>\n<p>In case of conformity defect, the Customer has the right to restoration, replacement or refund within the limits of the law.<\/p>\n<\/div>\n<h2>11. Liability<\/h2>\n<div>\n<p>The Seller is not responsible for:<\/p>\n<ul>\n<li>Misuse of products;<\/li>\n<li>Allergies, intolerances or reactions not declared by the Client;<\/li>\n<li>Delays or inefficiencies attributable to force majeure.<\/li>\n<\/ul>\n<\/div>\n<h2>12. Processing of personal data<\/h2>\n<div>\n<p>Customer&#8217;s personal data are processed in accordance with the Regulation (EU) 2016\/679 (GDPR).<\/p>\n<p>Complete information is available in the appropriate Privacy Policy posted on the Site.<\/p>\n<\/div>\n<h2>13. Intellectual property<\/h2>\n<div>\n<p>All contents of the Site (text, images, trademarks, logos) are the property of the Seller or the rightful owners and unauthorized reproduction is prohibited.<\/p>\n<\/div>\n<h2>14. Applicable law and place of jurisdiction<\/h2>\n<div>\n<p>The contract is governed by Italian law.<\/p>\n<p>For disputes with the consumer, the court of jurisdiction is the place of residence or domicile of the Customer, if located in Italy, as per art. 66-bis (Legislative Decree 206\/2005)<\/p>\n<\/div>\n<h2>15.
